1. About Equaly/xx.ai

Equaly/xx.ai is a compensation benchmarking platform providing salary range data drawn from official European sources (CBS, Eurostat, WageIndicator, and others). It is intended for use by HR professionals, compensation specialists, and individuals researching European salary markets.

2. Permitted use

You may use Equaly/xx.ai to:

• Research and benchmark salary ranges for HR, recruitment, and compensation planning purposes
• Upload anonymised team salary data for comparison against market data
• Generate salary range reports for internal business use
• Contribute anonymised salary data to improve the benchmarking dataset

You may not:

• Scrape, bulk-download, or resell Equaly/xx.ai's data or reports
• Use the platform for unlawful discrimination in hiring or compensation
• Upload files containing personally identifiable information (names, ID numbers, email addresses)
• Attempt to reverse-engineer, disrupt, or circumvent the platform's security measures
• Misrepresent Equaly/xx.ai's data as your own proprietary research

3. Data you submit

• You confirm that any salary data you upload or contribute does not contain personally identifiable information.
• You confirm you have the right to share the data (e.g. it is not confidential information you are prohibited from disclosing).
• Community contributions you submit may be used to improve Equaly/xx.ai's benchmarks and made available (in anonymised, aggregated form) to other users.
• Uploaded team files are not retained after processing. See our Privacy Policy for retention details.

4. Premium reports

• Premium market reports are available for purchase at the price displayed at the time of checkout.
• Payment is processed by Stripe. Equaly/xx.ai does not store payment card details.
• No refunds once a PDF report has been generated and made available for download, as the service has been fully delivered.
• If a report fails to generate due to a technical error on our side, you are entitled to a full refund. Contact support@equalyxx.ai.

5. Accuracy of salary data

Equaly/xx.ai aggregates and presents data from official European statistical sources. While we take care to validate and standardise this data, we make no warranty as to its accuracy, completeness, or fitness for any particular purpose. Salary ranges are statistical benchmarks, not guarantees of market rates for any specific role or individual. You should exercise professional judgment when using this data in compensation decisions.

6. EU Pay Transparency Directive tools

Equaly/xx.ai's compliance monitoring tools are informational aids to help HR teams prepare for the EU Pay Transparency Directive 2023/970. They do not constitute legal advice. You should consult a qualified employment lawyer regarding your organisation's specific compliance obligations.

7. Intellectual property

• The Equaly/xx.ai platform, interface, and software are our intellectual property.
• Underlying data from CBS, Eurostat, WageIndicator, and other official sources remains the property of those organisations, subject to their respective open data licences.
• Premium PDF reports you purchase are licensed to you for internal business use only and may not be resold or redistributed.

8. Limitation of liability

To the maximum extent permitted by applicable law, Equaly/xx.ai is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to losses resulting from compensation decisions made using Equaly/xx.ai's data. Our total liability for any claim related to the platform shall not exceed the amount you paid for the service in the 12 months preceding the claim.

9. Availability

We aim for high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the platform with reasonable notice where possible.

10. Governing law

These terms are governed by Dutch law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

11. Changes to these terms

We may update these terms from time to time. Continued use of Equaly/xx.ai after changes are posted constitutes acceptance of the updated terms. Material changes will be noted at the top of this page.
